A colleague of mine at UT, sharp guy, drove Uber for three months last year.

He has a PhD in economics.

And I kept thinking about that the whole time I was putting this episode together.

Right, and that tension is exactly what I want to dig into today.

Because depending on who you ask, the gig economy is either the most liberating shift in labor in a century, or the most sophisticated rollback of workers' rights we've ever seen.

Let's establish what we're actually talking about.

Because I think people hear 'gig economy' and they picture Uber drivers and food delivery, but it's much wider than that.

The gig economy includes anyone who works by jobs or 'gigs' rather than having a fixed contract with a company.

So the category is enormous.

We're talking about something like a quarter of the workforce in the US, maybe more if you count people doing it on the side.

In Spain the numbers are similar.

Hay más de tres millones de autónomos, que son los trabajadores independientes.

There are more than three million 'autónomos', which is the term for self-employed workers.

Pero no todos eligieron esa situación libremente.

But not all of them chose that situation freely.

Many are self-employed because they couldn't find permanent work, especially after the 2008 crisis.

That's where I'd want to start the historical thread, because this didn't come from nowhere.

The timing is not a coincidence.

You had a massive pool of desperate workers and a new technology that could coordinate them at scale.

That combination was irresistible for investors.

And the promise they sold was very attractive: 'You're your own boss.

And there are people who genuinely mean that when they say it.

I've talked to freelancers who would never go back to a traditional job.

The autonomy is real for them.

Yes, and I don't want to ignore that.

Hay gente para quien la economía gig funciona muy bien: profesionales con habilidades específicas y muy valoradas, que pueden negociar sus precios y elegir sus clientes.

There are people for whom the gig economy works very well: professionals with specific, highly valued skills, who can negotiate their rates and choose their clients.

For them, the flexibility is a real advantage.

But here's where I get stuck.

That group, the highly-skilled freelancer negotiating from a position of power, is not the same person as the delivery rider navigating an app that scores his every move.

Octavio ES

That's fundamental.

The problem is that we use the same word, 'gig economy', for two completely different realities.

Y las plataformas aprovechan esa confusión.

And the platforms exploit that confusion.

They talk about 'freedom' and 'flexibility' while controlling the time, the route, the price, and even communication with the customer.

The algorithm.

That's what makes this different from old-fashioned self-employment, isn't it.

A plumber in 1985 was also his own boss.

But nobody was tracking his route and threatening to deactivate him if his rating dropped.

Octavio ES

Exacto, ese es el punto clave.

Exactly, that's the key point.

The algorithm is the most demanding boss that exists.

It has no empathy, no context, it doesn't negotiate.

I read about a Deliveroo rider in London who got deactivated right before Christmas one year.

No explanation, no appeal process, no notice period.

Just, account closed.

That happens constantly.

Y en España tuvimos un debate muy serio sobre esto.

And in Spain we had a very serious debate about this.

Tan serio que el gobierno aprobó una ley específica en 2021, la llamada Ley Rider, para regular exactamente esta situación con los repartidores de plataformas como Glovo o Deliveroo.

So serious that the government passed a specific law in 2021, called the Rider Law, to regulate exactly this situation with delivery workers on platforms like Glovo or Deliveroo.

Walk me through what that law actually did.

Because Spain ended up being a test case for all of Europe on this.

Octavio ES

La Ley Rider estableció que los repartidores de plataformas digitales deben ser considerados empleados de la empresa, no trabajadores independientes.

The Rider Law established that delivery workers on digital platforms must be considered employees of the company, not independent contractors.

Eso significa que tienen derecho a un contrato, a la seguridad social, a vacaciones pagadas y a un salario mínimo garantizado.

That means they have the right to a contract, to social security, to paid vacation, and to a guaranteed minimum wage.

And the platforms did not take that sitting down.

It continued treating its riders as independent contractors for months after the law came into force.

Which tells you something.

If classifying your workers as employees is so catastrophic for the business model that you'll absorb massive fines to avoid it, then the entire model was built on not paying those costs.

Octavio ES

Completamente.

Completely.

Y ese es el corazón del problema.

And that's the heart of the problem.

Estas plataformas son rentables, en parte, porque transfieren los costes laborales al trabajador y a la sociedad.

These platforms are profitable, in part, because they transfer labor costs to the worker and to society.

El repartidor paga su propio seguro, su propio vehículo, su propio teléfono.

The rider pays for their own insurance, their own vehicle, their own phone.

Y si se lesiona en el trabajo, el sistema de salud público paga la factura.

And if they get injured on the job, the public health system picks up the bill.

The socialization of costs, the privatization of profits.

That's not a new story.

But the technology made it easier to disguise.

Octavio ES

Exacto.

Exactly.

Y tiene consecuencias muy graves a largo plazo.

And it has very serious long-term consequences.

Pensemos en las pensiones.

Think about pensions.

Si trabajas veinte años como repartidor de plataforma sin cotizar a la seguridad social, cuando llegues a la vejez, ¿qué pensión tienes?

If you work twenty years as a platform delivery rider without contributing to social security, when you reach old age, what pension do you have?

Ninguna, o una mínima.

None, or a minimal one.

Ese problema será enorme dentro de treinta años.

That problem will be enormous in thirty years.

The pension argument is the one that I find hardest to dismiss, even for people who are genuinely enthusiastic about gig work.

You might love the flexibility at thirty-two.

You might feel very differently about it at sixty-seven.

Eso es verdad.

That's true.

Y en España, donde el estado de bienestar es importante y la pensión pública es central para la vida de los mayores, este debate tiene mucha urgencia.

And in Spain, where the welfare state is important and the public pension is central to older people's lives, this debate is very urgent.

Si una generación entera trabaja en la economía gig sin cotizar, el sistema de pensiones no podrá sostenerse.

If an entire generation works in the gig economy without contributing, the pension system won't be able to sustain itself.

Now, the platforms have a counterargument here.

They say: we're creating opportunities for people who were excluded from the formal labor market.

In Spain especially, with historically high youth unemployment.

Octavio ES

Ese argumento me pone nervioso.

That argument makes me uneasy.

No porque sea completamente falso, sino porque se usa para justificar condiciones laborales que no aceptaríamos en ningún otro sector.

Not because it's completely false, but because it's used to justify working conditions we wouldn't accept in any other sector.

Sí, es mejor ganar algo que nada.

Yes, earning something is better than nothing.

Pero eso no significa que explotar a alguien sea aceptable simplemente porque antes estaba desempleado.

But that doesn't mean exploiting someone is acceptable just because they were previously unemployed.

That's the structural argument.

And I think it's right.

But I also want to make sure we're hearing the workers themselves, because they're not a monolith.

You talk to different people and you get genuinely different answers.

Octavio ES

Sí, tienes razón.

Yes, you're right.

Hay estudiantes que usan Glovo para ganar dinero extra mientras estudian y están contentos con eso.

There are students who use Glovo to earn extra money while they study and are happy with that.

Hay madres o padres que necesitan horarios flexibles por sus hijos.

There are parents who need flexible hours for their kids.

Y hay personas que no tienen otra opción y trabajan doce horas diarias sin descanso.

And there are people who have no other option and work twelve hours a day without a break.

La economía gig los trata a todos igual, aunque sus situaciones son completamente diferentes.

The gig economy treats all of them the same, even though their situations are completely different.

The student doing it for six months and the migrant worker doing it because every other door is closed are using the same app, taking the same risks, with the same zero protections.

That asymmetry is the thing.

Octavio ES

Y si miramos los datos de España, vemos que los repartidores de plataformas son, en una proporción muy alta, inmigrantes.

And if we look at the data from Spain, we see that platform delivery workers are, in a very high proportion, immigrants.

Hombres jóvenes de América Latina, del norte de África, del África subsahariana.

Young men from Latin America, from North Africa, from sub-Saharan Africa.

Personas que tienen menos recursos para exigir sus derechos y que son más vulnerables a la explotación.

People who have fewer resources to assert their rights and who are more vulnerable to exploitation.

I spent time in Latin America and I know that precariedad, the precariousness of working life, it's not new.

People have always cobbled together income from multiple sources.

The gig economy is almost a formalization of what informal economies already look like.

Octavio ES

Es una observación interesante.

That's an interesting observation.

Pero hay una diferencia importante: en la economía informal tradicional, al menos la comunidad y las relaciones personales ofrecen cierta protección.

But there's an important difference: in traditional informal economies, at least the community and personal relationships offer some protection.

In the gig economy, you're alone against an algorithm and a company with billions of dollars in capital.

And what about the future?

Because I keep reading that AI is going to automate a lot of this work away.

Which would solve the exploitation problem by eliminating the jobs entirely, which is not exactly a solution.

Octavio ES

Exacto.

Exactly.

Y eso crea una urgencia política real.

And that creates a real political urgency.

Si no regulamos bien la economía gig ahora, antes de que llegue la automatización masiva, perderemos la oportunidad de establecer estándares laborales para el futuro.

If we don't regulate the gig economy properly now, before mass automation arrives, we'll lose the chance to establish labor standards for the future.

La Ley Rider en España fue un primer paso, pero es solo eso, un primer paso.

The Rider Law in Spain was a first step, but it's just that, a first step.

If I had to summarize where I land, it's this: the flexibility was always real, and it genuinely serves some people.

But the freedom was a marketing story built on the elimination of every protection that a century of labor organizing had won.

Octavio ES

Estoy bastante de acuerdo contigo.

I'm fairly much in agreement with you.

Y mira que no siempre pasa eso.

And that doesn't happen often.

Creo que el debate real no es 'libertad o explotación', sino cómo diseñamos un sistema que permita la flexibilidad genuina sin eliminar los derechos básicos.

I think the real debate isn't 'freedom or exploitation', but how we design a system that allows genuine flexibility without eliminating basic rights.

Actually, I want to circle back to something.

You used a word earlier, 'autónomo', and I realized I don't fully understand its weight in Spain.

It doesn't just mean freelancer, does it.

Octavio ES

No, es mucho más que eso.

No, it's much more than that.

'Autónomo' es una categoría legal en España.

'Autónomo' is a legal category in Spain.

Significa que trabajas por cuenta propia, que eres tú quien paga la seguridad social, quien gestiona sus impuestos, quien asume todos los riesgos.

It means you work for yourself, that you're the one who pays social security, who manages your own taxes, who takes on all the risks.

Es lo opuesto de trabajar 'por cuenta ajena', que es cuando trabajas para una empresa que se ocupa de todo eso.

It's the opposite of working 'por cuenta ajena', which is when you work for a company that handles all of that.

Por cuenta propia versus por cuenta ajena.

I like that framing.

'On your own account' versus 'on someone else's account'.

It captures something about risk and responsibility that English doesn't really have a clean equivalent for.

Y ahí está el problema con la economía gig.

And there's the problem with the gig economy.

Las plataformas quieren que sus trabajadores sean autónomos, es decir, que trabajen 'por cuenta propia', asumiendo todos los riesgos.

The platforms want their workers to be 'autónomos', meaning they work 'por cuenta propia', taking on all the risks.

But at the same time, they want to fully control their work, as if they were employees working 'por cuenta ajena'.

It's a contradiction that judges across Europe are starting to resolve in favor of workers.

Having it both ways.

They want the control that comes with employment and the cost savings that come with outsourcing the risk.

You can't really dress that up.

No, no lo tiene.

No, it doesn't.

Y lo que me gusta de 'por cuenta propia' y 'por cuenta ajena' es que son expresiones muy antiguas en el español.

And what I like about 'por cuenta propia' and 'por cuenta ajena' is that they're very old expressions in Spanish.

Vienen de cuando alguien trabajaba para sí mismo, para su propia familia o negocio, frente a cuando trabajaba para otro.

They come from when someone worked for themselves, for their own family or business, versus when they worked for another.

La tecnología cambia todo, pero algunas preguntas fundamentales sobre el trabajo siguen siendo las mismas.

Technology changes everything, but some fundamental questions about work remain the same.
