Twilingua ("we", "us", or "our") provides the Twilingua mobile application (the "App"). By downloading, installing, or using the App, you agree to be bound by these Terms of Service ("Terms").
By accessing or using the App, you confirm that you are at least 13 years old (or 16 in the European Economic Area) and agree to these Terms. If you do not agree, you must not use the App.
Twilingua is a language learning application that uses podcast-style audio content delivered through a "sandwich" methodology: native language introduction, target language story, and native language debrief. The App provides:
To use the App, you must create an account by providing a valid email address. You are responsible for maintaining the confidentiality of your account credentials.
You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss arising from unauthorized use of your account.
The App may offer both free and premium subscription tiers. Premium features, pricing, and availability are described within the App.
Subscriptions are billed through the Apple App Store or Google Play Store. By subscribing, you agree to the payment terms of the respective platform.
You may cancel your subscription at any time through your device's app store settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.
If we offer a free trial, you will not be charged during the trial period. At the end of the trial, your subscription will automatically convert to a paid subscription unless cancelled beforehand.

All content in the App — including but not limited to audio episodes, transcripts, translations, illustrations, icons, and the App's design — is owned by Twilingua or its licensors and is protected by copyright and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial language learning purposes.
You retain ownership of your personal learning data. By using the App, you grant us a limited license to use anonymized, aggregated data for product improvement purposes.
The App is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the App's availability, accuracy, or fitness for a particular purpose.
We do not guarantee any specific language learning outcomes. Progress depends on individual effort, frequency of use, and other factors outside our control.
While we strive to provide accurate translations and language content, we do not warrant that all content is error-free. Language is inherently nuanced, and variations in interpretation are natural.
To the maximum extent permitted by law, Twilingua shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, or goodwill arising from:
Our total liability for any claim arising from these Terms or the App shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
You may stop using the App and delete your account at any time through the App's settings or by contacting us.
We may suspend or terminate your access to the App at any time, with or without cause, with or without notice. Reasons for termination may include violation of these Terms or extended inactivity.
Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) shall survive.
We reserve the right to modify these Terms at any time. Material changes will be communicated through the App or via email. Your continued use of the App after changes constitutes acceptance of the revised Terms.
These Terms are governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Berlin, Germany.
If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
